National Human Rights Consultation Submission AGWW-7NS9RS Name: Kien Choong Submission Text: Sir - my submission is on whether Australia requires a Bill of Rights. I do not think a Bill of Rights is necessary, nor am I strongly opposed to a Bill of Rights. If we do have a Bill of Rights, it should be a "statutory" Bill of Rights. I would be strongly opposed to a constitutional Bill of Rights. I am strongly opposed to giving courts a privileged position on adjudicating matters relating to human rights. This role should assumed by the Australian Human Rights Commission. If there is a statutory Bill of Rights, any alleged contravention of the statutory Bill of Rights should be investigated by an ad hoc committee established by the Human Rights Commission to hold a public inquiry into the alleged contravention with a view to making a recommendation to be tabled to Parliament if the alleged contravention is established. The ad hoc committee should be drawn from respected members of the public. Lawyers and judges should not necessarily be included in every ad hoc committee. It would be up to the committee to invite submissions from lawyers and judges about the subject matter of its inquiry.
